Recognizing that settled status is a significant privilege allowing free and unrestricted access to the labor market, NHS and welfare system, the Home Secretary, Shabana Mahmood, mentioned of the reforms taking place from November for the route to Indefinite Leave to Remain (ILR) for individuals in the UK. The forever right to live in the UK will no longer be granted to migrants almost automatically after 5 years. Instead, under the new settlement model, it will be earned depending on their contribution and their character. Now, the standard length of time the migrants will have to live in the UK in order to qualify for permanent settlement will double from five to 10 years. Under this 10-year pathway, applicants must have earned at least £12,571 for five of the seven years immediately before being granted settlement.
Summary of the changes include;
i.) Highest earners i.e. £125,141 per year will be able to settle within 3 years.
ii.) Shorter qualifying periods for some public service workers – like doctors, nurses and teachers including those earning more than £50,271, they all will be able to settle after 5 years.
iii.) Others will settle at a new default of 10 years.
iv.) For the ones who have breached immigration rules, they will only be able to settle after at least 20 years.
v.) Anyone seeking settlement, regardless of when they arrived in the country, will first need to meet 4 non-negotiable conditions:
- a spotless criminal record (up from the current threshold of a 12-month suspended sentence);
- English language ability spoken to a high standard i.e. should be equivalent to A-Level English as a foreign language;
- no debt or pending debt owed to the government;
- a record of sustained National Insurance contributions;
vi.) Care workers who made their contribution to Britain when the sector was whirling from the COVID-19 pandemic, who as well met their visa conditions and earned at least £25,000 a year, will be able to settle after 5 years. Those who do not meet this threshold (which is estimated at around a quarter of those affected) will be offered a further five-year visa, after which they may apply for settlement. Similar approach will be applied to public service workers in healthcare and education who arrived during the same period.
vi.) Refugees who arrived in the UK through an official government scheme will qualify for settlement after five years.
