The first step towards any Immigrant Visa asks the applicant to obtain a Labor Certification by the Department of Labor and Filing a Petition, Form I-140. Employment base immigration are divided into 5 categories out of which E1 is described below.
Employment First Preference (E1) includes list of Priority Workers and Persons of Extraordinary Abilities and is divided into three sub- groups.
Persons with extraordinary ability includes individuals who have received national or international acclaim in the areas of arts, sciences, business, education, or athletics. They must have been recognized in their respective fields of expertise and need not has to have specific job offers. They, however, should be able to contribute in their respective fields of expertise in the USA. Such applicants can file their own Immigrant Petitions for Alien Worker, Form I-140, with the USCIS.
Outstanding professors and researchers includes individuals who are internationally known and possess at least three years experience in teaching or research. This category includes candidates who are coming to the U.S. to pursue tenure, tenure track teaching, or a comparable research position at a university or an institution of higher education. A job offer must be provided by the prospective employer. Likewise, an Immigrant Petition for Alien Worker, Form I-140, with the USCIS must be filed by the prospective employer.
Multinational managers or executives includes individuals who have been associated and employed for at least one of the three preceding years by the overseas affiliate, subsidiary, parent or branch of the U.S. employer. In addition, employment outside of the U.S. must have been in a managerial or executive capacity, and the applicant must be coming to the USA to contribute in a managerial or executive capacity. The prospective employer must provide a job offer and file an Immigrant Petition for Alien Worker, Form I-140, with the USCIS.
